Aiarchiviz Remote Sales Agreement

1. SUBJECT

This Aiarchiviz Remote Sales Agreement (“Agreement”) concerns the sale and delivery of the product (“Product”) specified below, with its characteristics and sales price, by the SELLER to the BUYER, in accordance with the provisions of the Law on the Protection of Consumers No. 6502 and the Remote Contracts Regulation published in the Official Gazette dated November 27, 2014 and numbered 29188, covering the rights and obligations of the parties. All information and promises regarding the Product provided to the BUYER are valid until any changes are made to the Product information and published.

2. DEFINITIONS

The terms below shall have the meanings assigned to them in this Agreement and in the application and interpretation of this Agreement:

• BUYER: A natural person who acquires, uses, or benefits from a good or service for purposes other than commercial or professional.

• Ministry: The Ministry of Trade of the Republic of Turkey.

• Bank: A licensed institution established under the Banking Law No. 5411.

• Service: Any consumer transaction other than the provision of a product for a fee or consideration.

• Law: The Law on the Protection of Consumers No. 6502.

• Pre-Contract Information Form: The form prepared before the conclusion of the contract or any offer is accepted by the BUYER to inform the BUYER about the minimum information required by the Regulation.

• SELLER: A natural or legal person, including public legal entities, who offers or supplies Products/Services to consumers for commercial or professional purposes, or who acts on behalf of or for the account of the person who offers or supplies Products/Services, and whose information is as follows:

• Agreement: The Agreement concluded between the SELLER and the BUYER.

• Product: Any intangible asset, such as software, sound, image, or any other type of digital asset, intended for use in an electronic environment.

• Regulation: The Remote Contracts Regulation.

For fast communication, suggestions, requests, complaints, and all kinds of solutions between the SELLER and the BUYER, the info@aiarchiviz.com email address will be the primary communication tool. If it is not possible to reach the relevant email address, the communication channels listed above will be used. Topics not sent to this email address will be considered as not requested by the BUYER.

4. PRICE AND BASIC CHARACTERISTICS OF THE PRODUCT SOLD

The name of the Product, its sales price including all taxes, and its basic characteristics are as follows:

Aiarchiviz.com: The aiarchiviz.com website, operated by Blick3d Prodüksiyon Mimarlık Limited Şirketi, is a platform containing blogs, educational sets, informative articles, and online services. The BUYER, upon becoming a member of the site, will be able to benefit from the blogs, educational sets, articles, and other educational materials published on the website.

AIARCHIVIZ MEMBERSHIP PACKAGE

• Product/Package Name: Annual Membership , Monthly Membership

• Product/Package Description: The Annual Membership , grants the BUYER access to all content published on the aiarchiviz.com website without any further action. The membership period is 1 year. The BUYER cannot claim any rights from the SELLER for the trainings not used by the BUYER at the end of the membership period.
  

• The Monthly Membership , grants the BUYER access to all content published on the aiarchiviz.com website without any further action. The membership period is 30 Days. The BUYER cannot claim any rights from the SELLER for the trainings not used by the BUYER at the end of the membership period.
  

• Annual Membership Fee (All Taxes Included):

• Montly Membership Fee (All Taxes Included):

AIARCHIVIZ TECHNICAL SUPPORT AND POST-SALES TRAINING INCLUDED MEMBERSHIP FEES

Payment Methods: Payment can be made via PayTR credit or debit cards and PayTR’s offered Card Points/Prepaid Card BKM Express/paypal/Tosla/Juzdan methods or directly via bank transfer/EFT. Direct bank transfer/EFT can also be made to the SELLER’s bank account.

Aiarchiviz membership sales are only carried out through the aiarchiviz.com website. The SELLER is not responsible for payments made through communication channels and payment methods not listed on the specified website.

If the BUYER selects the corporate invoice option in their order, the SELLER will issue a corporate invoice using the tax identification number and tax office information provided by the BUYER through the Platform. The BUYER is solely responsible for the accuracy, currency, and completeness of the information provided in the invoice, and is liable for any damages arising therefrom.

6. RIGHT OF WITHDRAWAL

The products and services covered by this Agreement are provided to the BUYER upon activation of the BUYER’s membership, and fall under the scope of electronically delivered services as defined in Article 15-ğ of the Remote Contracts Regulation. The products and services covered by this Agreement are not included in the scope of the Remote Contracts Regulation and the BUYER has the right to withdraw from the contract without any legal or criminal liability.

7. SPECIAL TERMS

7.1 Aiarchiviz is an online service platform. After purchasing a membership package, the content will be provided to the BUYER online. No download link or physical delivery will be made after purchase.

7.2 The BUYER acknowledges that they only have access to the content included in their purchased membership. The intellectual property rights of the content belong to Blick3d Prodüksiyon Mimarlık Limited Şirketi. The content cannot be reproduced, published, and sold without permission. The BUYER’s membership will be terminated by the SELLER without any refund. The SELLER reserves the right to pursue legal action for any damages.

7.3 Aiarchiviz being an online service platform, the SELLER is not liable for any short-term disruptions that may occur due to updates, maintenance, and similar situations.

8. GENERAL PROVISIONS

8.1 The BUYER declares and undertakes that he/she has read the SELLER’s website’s Pre-Contract Information Form, Pre-Contract Information Form and this Agreement and accepts the terms and conditions of the Agreement.

8.2 This Agreement is effective upon the date of the Agreement and the BUYER’s electronic acceptance.

8.3 If the BUYER’s provided information is incomplete, forged, or incorrect, or if the membership is used in bad faith, the SELLER reserves the right to suspend or terminate the service.

8.4 The SELLER is not liable for any responsibility for internet banking fraud. The SELLER does not provide any security commitment for banking transactions.

8.5 If the BUYER uses a third party’s credit card illegally, the SELLER reserves the right to suspend or terminate the service.

8.6 The BUYER can send their complaints to info@aiarchiviz.com. If the complaint is found to be valid, the BUYER can use their rights under Article 15 of the Law.

8.7 The SELLER reserves the right to transfer the Agreement and/or the rights and obligations under this Agreement and/or the Product to a third party or organization without any notification to the BUYER.

8.8 The SELLER’s obligations under this Agreement may be suspended or terminated, wholly or partially, temporarily or permanently due to natural disasters, war, mobilization, fire, government and administrative decisions and similar events. The SELLER will not be liable for failing to fulfill its obligations. The Agreement’s essential terms are fulfilled, the events will not be considered as a force majeure.

**9. DISPUTE RESOLUTION

Any dispute arising from this Agreement will be subject to the jurisdiction of the İstanbul Courts and Execution Offices. The BUYER can also file a complaint and objection to the Consumer Dispute Resolution Body or consumer court in the place of purchase or residence.

**10. ENTRY INTO FORCE

This Agreement is effective upon the date of the Agreement and the BUYER’s electronic acceptance. A copy of the Agreement can be sent via email.
